If you received an Actual Cash Value payment from PEMCO for a claim concerning damage or destruction of personal property under a PEMCO Property Insurance policy issued on any Washington property and which Actual Cash Value payment included at least one alleged deduction of a percentage of the sales tax from the Replacement Cost for an item of damaged or destroyed personal property any time after June 1, 2014, please carefully read this notice. It may affect your rights.

• Tina Mackay (referred to in this notice as “Plaintiff”), has sued PEMCO Mutual Insurance Company (referred to in this notice as “Defendant”) based on alleged violations of state law.

• The Court has allowed the lawsuit to proceed as a class action on behalf of all consumers who received an Actual Cash Value payment from PEMCO for a claim concerning damage or destruction of personal property under a PEMCO Property Insurance policy issued on any Washington property and which Actual Cash Value payment included at least one alleged deduction of a percentage of the sales tax from the Replacement Cost for an item of damaged or destroyed personal property any time after June 1, 2014.

• Defendant denies all of the allegations in the lawsuit.

• The Court has not decided whether Defendant did anything wrong. There is no money available at this time and no guarantee there ever will be. However, your legal rights will be affected. You have a choice to make now, by the deadline of June 6, 2022:
