This case is currently pending in the Los Angeles Superior Court, Central District of California as Case No. BC 445402.  The judge is the Honorable Maureen Duffy-Lewis.  To see a copy of the Complaint, click here.  

In the Lawsuit, Plaintiff alleges breach of contract, fraud, misrepresentation, conversion and violations of business & Professions Code Section 17200 against Defendant based on the allegation that LA Financial failed to provide adequate notice of automated teller machine (“ATM”) fees being charged in the amount of $2.00.  To see a copy of the class action publication notice, click here.  To see which ATM in issue, click here.

Defendant denies Plaintiff’s claims of wrongdoing but has agreed to settle all claims against it to avoid the expense of continued legal proceedings.  To see a copy of the Settlement Agreement, click here.
