Typically, a class action lawsuit involves a large group of people injured by the same conduct. Here are some examples of Class Actions:

  • Employment Class Actions: Brought on behalf of employees of a company for violations of the Labor Code (such as unpaid overtime, failure to provide breaks, safety violations and systematic workplace discrimination).
  • Consumer Class Actions: Brought when consumers are injured by a company’s systematic and illegal practices (such as illegal charges on bills, illegal penalties for late-payments and failures to comply with consumer protection laws).
  • Product Liability/Personal Injury Class Actions: Brought when a defective product (such as a drug with negative side effects) or ‘mass accident’ (such as a toxic spill) harms many people.
  • Securities Class Actions: Brought on behalf of a group of investors injured as a result of improper conduct (such as misstating earnings, concealing or misrepresenting risks, or otherwise engaging in activity detrimental to a company, partnership or individual investors).

You can still file a claim even if you lack the requested documentation. You may receive a letter from CPT Group, Inc. stating that your claim is deficient, and you will be given time to fully complete the Claim Form. However, if your Claim Form remains incomplete, it may be rejected and you may be excluded from participating in the settlement fund.

There are no costs associated with joining a class action lawsuit or a class action lawsuit settlement. Attorneys are not paid unless they win or settle a case, and said payment typically comes from the settlement fund.

The Court has scheduled a hearing to consider the fairness, reasonableness and adequacy of the proposed Settlement and to consider the request of plaintiffs’ counsel for the award of attorney’s fees and expenses. Your request for exclusion must be received by the Claims Administrator by the set deadline and must include all of the following: your name, address and telephone number; and your wish to be excluded from the Class. Patience is key when making a claim on a class action settlement. Once you make your claim, you must still wait for the claims period to end, and for the judge to review the case at final approval. This delays payment since it cannot be disbursed until all challenges are resolved.
