UPDATE (As of July 26, 2017): Great News! The settlement check disbursements have been completed and have been mailed out to all the class members. Checks will be valid for 180 days from issuance. Any expired, uncashed checks will be transferred to the California Unclaimed Property Fund in the name of and for the benefit of such class members.


On April, 2017: The Ninth Circuit has dismissed the objector appeals, finding them to be frivolous. We hope that settlement checks can be calculated and prepared for distribution within the next several months, but timing is still uncertain. Please check back periodically through the website, and when we have a firm distribution date for the checks, we will update this posting.


On November 15, 2016: The district court entered an Order denying Objector Walter Ellis’s Application to Proceed in Forma Pauperis, certified that Objectors Walter Ellis and Randall Pittman’s Appeals are not taken in good faith, and granted in part and denied in part Plaintiffs’ motion to require posting of appeal bond.

UPDATE (October, 2016): Court grants final approval of settlement; objectors appeal settlement delaying payments until appeal is resolved and settlement agreement becomes final.


On October 24, 2016: Objector Walter Ellis filed a Notice of Appeal to the 9th Circuit Court of Appeals. On October 31, 2016, Objector Randall Pittman filed a Notice of Appeal to the 9th Circuit Court of Appeals.

On October 13, 2016: The district court granted final approval of a class-action settlement of this action, granted Plaintiffs’ motion for approval of attorneys’ fees, costs and incentive awards, overruled objections to the class action settlement, and entered final judgment.

Distributions under the Settlement Agreement will not be made unless and until the Settlement Agreement becomes “final”. In light of the pending appeals, the Settlement shall become final after the 9th Circuit has rendered a final decision or opinion affirming the district court’s final approval without material modification, and the applicable date for seeking further appellate review has passed, absent any earlier dismissals of the appeals.
